MINUTES OF THE TOWN COUNCIL MEETING HELD ON 10 JULY 2006
3988.PRESENT. Councillor B Pickering the Town Mayor in the Chair, together with Councillors G C Ferguson, T Robson, J V R Hare, H J C Herron, M Way, J B Jonas, N Wicks, M F C Donnelly, D Kennedy and Mrs I C Whale.
3989.APOLOGIES FOR ABSENCE were received from Cllrs: - Mrs C J Robinson, J M Lambert and Mrs J C Soulsby.
3990.THE REVD. GRAHAM USHER spoke about a suggestion for a Hexham Abbey historic interpretation centre. It would also allow for office and toilet accommodation for Abbey staff and visitors. At present the idea was in the very early stages but he asked for and was given the support of the Council.
3991.WIND FARMS. Mr C Ormston of Amec Wind Energy gave a presentation on his Company plans for a wind farm in the north of Tynedale district. After answering questions the Mayor thanked him for his attendance and the information provided.
3992.MINUTES. It was AGREED the Minutes of the Council meeting held on the 5 June 2006 having been circulated, be signed as a true record subject to amending a spelling error in Minute 3975.
3993.MATTERS ARISING.
a. BUS SHELTER [opp. Hospital]. Minute 3971d refers. The NCC had asked that the Council reconsider its decision not to accept a replacement shelter. It was AGREED the decision would stand and unless a stone built shelter was provided the Council would not accept an alternative replacement or responsibility for it. The NCC considered the Council should consider the crime and crime fears that stone shelters may bring to users but it was felt that Hexham had no crime problems in shelters [of any style] and had not had any problems so far as anyone remembered and so this reason was not considered valid. It was AGREED to store any recoverable stone for future use.
BURIAL BOARD
[Minute 3976d refers]. Cllr J B Jonas the Committee Chairman reported on a
matter arising from the Burial Board minutes of 22 May 2006 regarding tenders
being obtained for a replacement Lodge central heating boiler. A memorandum
giving details of the tenders obtained was circulated and it was noted the
tenders were as follows. [Tenders had been sought from six local firms of
heating engineers and three quotes were received by the closing date].

It
was AGREED the lowest tender of J P Westall Ltd be accepted and the work
carried out as soon as convenient and prior to the coming winter period.
Finance will be available from the current budget by deferring decoration of
Cemetery premises and pending a further perusal of Cemetery finances by the
Burial Board committee in due course.
3994.DECLARATIONS OF INTEREST. Cllr Mrs I C Whale as a County Councillor declared a personal interest in agenda Item 12. Cllr T Robson as an affected resident declared a personal interest in agenda Item 12.
3995.ACCOUNTS FOR PAYMENT. It was AGREED to authorise payments in accordance with the lists circulated and as attached hereto.
3996.PLANNING DECISIONS. It was AGREED to receive the decisions of Tynedale Council on planning applications in accordance with the list circulated and attached hereto.
3997.COMMITTEE REPORTS:-
a. It was AGREED to receive the minutes of the Town Council Planning Committee meeting held on 5 June 2006, presented by the Deputy Mayor, Cllr J B Jonas.
b. It was AGREED to receive the minutes of the Hexham Community Partnership meetings held on 15 May 2006, 12 June 2006 and 26 June 2006, presented by Cllr M Way. It was AGREED to ask the Regeneration Officer, Ms T Beevor to attend the next meting of the Council if she was available.
3998.GRANT AID 2006/7. Letters of thanks for grants made had been received from:-
a. Gt North Air Ambulance
b. Hexham Abbey Festival
3999.WENTWORTH. A complaint was noted from a Mr Howell. He considered the booking of the Wentworth Car Park for a visiting fairground would bring problems to himself and other residents living in the area. It was AGREED as the matter was the responsibility of Tynedale Council the letter be passed to that authority.
4000.ACCOUNTS 2005/6. Copies of the Accounts had been circulated and it was AGREED the Statement of accounts and the Statement of assurance be approved. The report of the Internal Auditor was also received and approved.
4001.THIS MINUTE PURPOSELY LEFT BLANK.
4002.NCC PARKING PROPOSAL – ELVASTON ROADS AREA. The NCC proposal for amendments to existing parking restrictions was AGREED.
4003.QUALITY COUNCIL. A proposal by Cllr T Robson that the Council set up a working group to look into this scheme did not receive a seconder.
4004.NEXT MEETING. The next meeting of the Council would be held on 7 August 2006.

interest.
This is a memorandum for Parish/Town councillors prepared from recent information sent to your Clerk by the Standards Board for England.
It is for Councillors in their capacity as Parish /Town Councillors. If you are a ‘dual hatted member’ then you must address any queries you may have as such a member, to your respective District and/or County Council legal advisor.
Prejudicial
interests.
Is it prejudicial? Not all matters in which you have a personal interest are prejudicial although you still must declare the personal interest. If it is not prejudicial you may stay in the meeting and speak and vote. It is only when it is prejudicial that you must leave the room.
How do you decide if it is prejudicial? You have a personal interest if the matter has an impact upon the area of the ward in which you live to a greater extent than others living in the area of the authority. The interest is only prejudicial if it also has a significant impact upon yourself, your friends, or your relatives or any other categories set out in para 8[1][a to d] of the Code, so that a reasonable member of the public would consider that your judgement of the public interest was prejudiced.
As an example, if a planning application for a piece of land in your ward is situated opposite your property then it is likely to be prejudicial.
The Board states that ‘It is likely in the normal course of events that a Councillor who has an interest shared with the community or an organisation they represent, can take part in the meeting. It is only when a decision is being made and the Councillor will get a clear advantage from the decision that there is a prejudicial interest’.
Dual hatted members. Although this memorandum is addressed to Parish/Town Councillors, dual hatted members may like to note the following comments also expressed by the Board.
‘If the Town/Parish Council [of which you are a member] has already considered a matter under discussion [by the District/County] and the matter has no direct impact upon you or your friends, family etc. then you only have a personal interest [to declare] as a member of the Parish/Town Council. At the Parish/Town Council level you should make clear you will reconsider the matter at District/County level after taking into account all relevant evidence and representations at the District/County level. At the District/County level, you should declare a personal interest [not prejudicial] arising from your membership of the Parish/Town Council that has already expressed a view on the matter, making it clear that the Parish/Town Council’s view does not bind you and that you are considering the matter afresh.
However if the matter relates directly to your Parish/Town Council, such as a planning application by it, or a contract between it and the District/County, then you must withdraw during discussion of the application or contract’.
